NIGHT OWL WORLD — Online Menu & Order

These Terms and Conditions ("Terms") govern your use of the NIGHT OWL WORLD food ordering website and app (the "Service"). By browsing the menu, creating a session, or placing an order, you agree to these Terms.

1. Acceptance of Terms

If you do not agree to these Terms, do not use the Service. We may update these Terms periodically; the effective date shown on this page will be revised when we do. Continued use after changes constitutes acceptance.

2. Eligibility and account

You must provide accurate contact details (such as a valid phone number) to place orders. You are responsible for activity under your session and for keeping OTPs and device access secure. The Service is for personal, non-commercial ordering unless we agree otherwise in writing.

3. Orders and acceptance

Placing an order is an offer to purchase food and related items from NIGHT OWL WORLD. An order is accepted when we confirm it (for example, via status update, call, or notification). Menu items, descriptions, images, and prices may change and may not always be available. We may refuse or cancel an order due to unavailability, operational constraints, suspected fraud, or errors in pricing or information.

4. Pricing, taxes, and fees

Prices shown at checkout are in Indian Rupees unless stated otherwise and may include applicable taxes, packaging, and delivery or service charges as displayed before you confirm.

5. Payments

We may offer online payment (UPI, cards, wallets, net banking, or other methods enabled by our payment partner) and, where available, payment at delivery or pickup. Online payments are processed by a third-party gateway. A successful charge does not guarantee acceptance until the restaurant confirms the order. If payment fails, is reversed, or is flagged as incomplete, we may cancel the order. You authorize us and our payment partner to collect amounts due for confirmed orders.

6. Delivery and pickup

Estimated preparation and delivery times are indicative only and not guarantees. Delivery is available only within the restaurant's serviceable area and may depend on rider availability, weather, traffic, and order volume. For delivery orders, you must provide a complete and accessible address and be reachable at the phone number provided. Risk in the food passes to you on handover at pickup or delivery, subject to applicable consumer law.

7. Cancellations

You may request cancellation before the restaurant has started preparing or dispatched the order, subject to status shown in the app and restaurant policy. Once preparation or dispatch has begun, cancellation may not be possible. The restaurant may cancel if an item is unavailable, if delivery cannot be completed, or for other operational reasons. Refunds for cancellations follow our Refund Policy.

8. Food quality, allergens, and packaging

We aim to prepare and pack orders carefully. Menu descriptions may not list every ingredient or allergen. If you have allergies or dietary restrictions, contact the restaurant before ordering. Report missing items, wrong items, or quality issues promptly with your order details so we can investigate.

9. Acceptable use

You agree not to misuse the Service, including by placing fraudulent orders, abusing promotions, harassing staff or delivery partners, scraping the Service, interfering with security, or using the Service for unlawful purposes.

10. Limitation of liability

To the fullest extent permitted by law, NIGHT OWL WORLD is not liable for indirect, incidental, or consequential losses arising from use of the Service, delayed delivery, or temporary unavailability. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law, including for proven deficiency in service where required by law.

11. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to mandatory consumer protections, courts in Ajmer, Rajasthan shall have exclusive jurisdiction over disputes arising from these Terms or the Service.
